Checking potential employees can legally work in UK.

Recently I have noticed a lot of press coverage about a large company that were suspected of employing people working illegally. We are a small employer but should we be doing anything to ensure our workers are legally entitled to work in the UK or does this law only apply to big employers?

A customer was being very difficult insisting that we invoice another company for a repair they wanted to be undertaken to their car. The other company were not happy to accept the invoice and so we refused to undertake the repair to the car because it looked like we would not get paid.

The customer is upset that we have refused to repair the vehicle and has issued a claim against us for breach of contract. The customer is seeking to claim the cost of repairing her car and the loss incurred from the insurance company for transferring her insurance to our courtesy car.

We repaired a car and parked it outside waiting for the owner to pay before he collected the car. We never let cars go unless we receive payment and if a customer wants to inspect our work we always send an employee with the keys so that the customer cannot simply drive a car away until our invoice is paid.

Unfortunately the customer, seen on CCTV, returned with a duplicate key and drove the car away without paying our invoice. We called him in the morning to say the repair had been completed; he came in the afternoon and took the vehicle.

What can we do?

Really appreciate your bulletins, just wondered whether you could answer my question, last week I discovered that one of our employees, who is a key holder, has been entering the premises and taking equipment to use on jobs that he is doing in his own time.

I have checked his contract, which is quite short only a few pages, but there is nothing in it which helps. I have been thinking of updating our employment contracts for some time but never actually get around to it.

What should I do, can I discipline him?
