Insurer informing our Customers not to use our services. What can we do?

We are a manufacturer approved crash repairer, and we have heard from several customers from a particular insurer that the insurer is informing customers that they cannot use our services and the insurer is giving a number of what we believe are inaccurate reasons. The customers choose our company we create an estimate and then the vehicle is removed.

Insurer refusing to pay for Diagnostic Sweep. What can I do?

Help? A vehicle manufacturer, we are approved by, has informed us that it is important that we;

  1. undertake a sweep of the vehicle’s diagnostics system prior to starting the repair process, and
  2. also undertake a sweep when the repair process has been completed.
  • Apparently checking the diagnostic systems before the repair will highlight if there are any faults with the systems which may have been caused by the impact. Checking after confirms that certain fault codes that may arise as a result of the repair process can be removed.

Should my employees have an emplioyment contract?

As soon as you offer to employ someone, and that offer is accepted there is an employment contract. The contract should ideally be in writing, but can be verbal or implied.
A contract, whether written, verbal or implied is a formal agreement between you, the employer, and your employee. The contract sets out the employment conditions, rights, responsibilities and duties of both the employee and employer.
Not all people that undertake work for you will be employees, you may subcontract certain tasks or use self employed ‘consultants’, this isn’t an employment contract but a ‘contract to provide services’.
The employment conditions, rights and duties etc, are the ‘terms’ of the contract and the parties must comply with these terms otherwise they will breach the contract. Terms can be changed usually with the agreement of both parties.

Use of in car cameras and recording equipment whilst vehicle being repaired.

A customer recently recorded the entire repair process on an ‘in car’ camera. The customer was happy with the service provided but we wondered if it is appropriate to allow customer’s in car cameras to record events in the workshop?

The ultimate decision as to whether ‘in car’ cameras and recording equipment should be allowed into the workshop should be decided by the repairer who owns and/or operates from the premises. Whatever you decide your employees should be made aware that their action may be recorded and that they should be vigilant for ‘in car cameras’.
